Terms of Service

These terms govern your use of Nordkestrel Dining. Read them — they describe what we both agree to, what you control, and what happens when things go sideways.

1. Who we are

Nordkestrel Dining (“Nordkestrel,” “we,” “our”) is operated by Nordkestrel Inc., a company based in Canada. These terms apply to the platform at nordkestrel.ca, the admin portal at admin.nordkestrel.ca, and every storefront hosted on a nordkestrel.ca subdomain.

2. Who can use the service

You can use Nordkestrel if you are a legal entity or adult operator running a legitimate food business, and you have authority to bind that business to these terms. If you sign up on behalf of a business, you confirm you are authorized to do so.

3. Your account and restaurants

You are responsible for the accuracy of the information you submit, for the security of your sign-in credentials, and for the actions of anyone you invite as staff. You can invite, remove, or change roles for staff at any time from your dashboard.

4. Your content — menus, orders, customers

Menus, orders, customer records, branding, and any other data you upload remain yours. We store it only to operate the service. You grant us a limited license to host, transmit, and display that content as necessary to deliver the service to you and your customers.

We do not sell your data. We do not use it to train models. You can export your data at any time as CSV.

5. Fees and payments

Plan fees

Subscription plan prices are listed on the pricing page. Fees are billed in advance for the plan you select. You can change plans at any time from your dashboard; upgrades apply immediately, downgrades apply at the end of the current billing period.

Stripe processing

Payments are processed by Stripe directly to your connected Stripe account. Stripe's standard processing fees apply and are deducted by Stripe — Nordkestrel does not take a percentage of your order revenue.

Refunds

Plan fees are non-refundable by default. Contact us if you believe you were billed in error.

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, provider outages (Cloudflare, Stripe, Clerk, Resend), and emergency mitigations may cause temporary downtime. We notify you of significant incidents through the admin portal or email.

8. Suspension and termination

You can cancel your account at any time from the dashboard. On cancellation, your data remains exportable for 30 days, after which it is permanently deleted.

We may suspend or terminate accounts that violate these terms, that pose a safety or compliance risk, or whose payments are more than 14 days overdue. Where possible we will notify you before taking action.

9. Warranties and liability

The service is provided “as is.” To the fullest extent permitted by law, Nordkestrel disclaims implied warranties and limits total liability in any 12-month period to the fees you paid us in that period.

10. Changes to these terms

We may update these terms. Material changes will be communicated by email and by a notice on this page at least 14 days before taking effect. Continued use after that date constitutes acceptance.

11. Governing law

These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of Ontario unless otherwise required by applicable consumer protection law.
